RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

Because all off-road vehicle riding in the desert is dangerous and can lead to serious injury or death, the County of San Bernardino requires that, in consideration for being allowed to ride an off-road vehicle in Moabi Regional Park, each person who signs this document agrees to each of the following:

  1. To assume full responsibility for, and hereby acknowledges the risk of, any bodily injury, death or property damage that may arise from riding any type of off-road vehicle anywhere within the confines of Moabi Regional Park or on adjacent property, whether such bodily injury, death or property damage is caused by:
    1. a condition of the property of Moabi Regional Park or adjacent property; and/or
    2. the negligence of the County of San Bernardino or any of its employees, agents, officers, volunteers or contractors;
  2. To release, waive, discharge and covenant not to make a claim against or to sue the County of San Bernardino or any of its employees, agents, officers, volunteers, or contractors from all liability for bodily injury or death or property damage from any course whatsoever including but not limited to a condition of the property of Moabi Regional Park or adjacent property or the negligence or other acts of the County of San Bernardino or any of its employees, agents officers, volunteers or contractors;
  3. To indemnify, save and hold harmless the County of San Bernardino and its employees from any and all loss, liability damage or cost that may be incurred due to the riding of any type of off-road vehicle anywhere within the confines of Moabi Regional Park or adjacent property of the negligence or other acts of the County of San Bernardino or any of its employees, agents, officers, volunteers or contractors, from any course whatsoever, including the negligence of any person.
  4. To attest that no oral representations, statements, or inducements apart from the foregoing written agreement have been made;
  5. To give consent to whatever medical care might be provided or available on the premises and to conform and comply with all the rules and regulations of the park.
  6. To read and voluntarily sign this Release, Waiver and Indemnity Agreement.
  7. I am aware of and specifically waive the provisions of California Civil Code Section 1542, which provides as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

I agree that I will not allow anyone to operate or ride on the off-road vehicle(s) which I am bringing into Moabi Regional Park unless the operator or rider has first signed this form and if I fail in this regard I will indemnify and hold harmless the county of San Bernardino and its employees as per the terms contained in paragraph number three above in any lawsuit involving someone who has not signed this form.
